By using this website and completing an order, you acknowledge and accept these terms in full.

2. Customer Account & Ordering

Account Creation
You may place an order by creating a customer account, logging into an existing account, or checking out as a guest.

You are responsible for maintaining the confidentiality of your account credentials.

Placing an Order
For each product, the order summary will display price, colour, reference details, and quantity.

Once confirmed, the order is transmitted to L’EAUPHANT for processing.

Product colours and visuals may vary due to technical display differences and shall not be considered a defect.

L’EAUPHANT reserves the right to refuse or cancel orders in cases of stock unavailability, pricing errors, or inaccuracies in product information.

Personalised Products
Orders for personalised or custom-made items are final and cannot be cancelled, exchanged, or returned.

3. Product Availability & Pre-Orders

All products are offered subject to availability.

Quantity limits per customer may apply where necessary.

For pre-orders, the estimated availability date is indicated on the product page.

If the product becomes unavailable after purchase, the order will be cancelled and fully refunded.

4. Order Confirmation

By clicking “Pay” or the equivalent confirmation button, you finalize your order.

No modifications can be made once the order is confirmed.

5. Pricing & Payment

Prices are displayed in the currency applicable to your selected region.

For international orders, VAT, customs duties, and import taxes are not included and remain the responsibility of the customer.

Payment is charged at the time of order confirmation.

Secure payment protocols, including 3D Secure and similar authentication systems, are applied where available.

6. Shipping & Delivery

International Shipping
All international shipments are dispatched under DAP (Delivered At Place) terms.

Accordingly, the customer is responsible for:

L’EAUPHANT cannot be held responsible for customs-related delays or additional charges imposed by local authorities.

Customs practices may vary by country; customers are advised to consult their local regulations prior to ordering.

7. Delivery Conditions

All deliveries require a signature upon receipt.

Certain categories, including made-to-order or custom items, may require extended preparation and delivery times.

8. Delivery Issues

If delivery is delayed beyond ten (10) business days from the estimated date, the customer should contact Customer Care.

Any visible damage or discrepancy must be noted at the time of delivery.

9. Transfer of Risk

Products remain under L’EAUPHANT’s responsibility until delivery.

Risk transfers to the customer upon confirmed receipt.

10. Returns, Exchanges & Refunds

Right of Withdrawal
You have the right to cancel your order within 14 days of receiving your delivery, without providing a reason. To exercise this right, please notify us by email at customercare@leauphant.com, including your order number and the reason for return. All returns must be pre-approved — returns sent without prior notification will not be accepted, and any costs incurred will remain the customer's responsibility.

Return Conditions
To be eligible for a return, the item must:

• Be unused, undamaged, and in resalable condition, exactly as delivered.
• Include the original box, packaging, tags, seals, accessories, and invoice.
• Show no signs of use beyond reasonable inspection.

L'EAUPHANT reserves the right to refuse returns of items that have been worn, altered, damaged, or are not in resalable condition. Any loss in value resulting from handling beyond what is necessary to inspect the item may be deducted from the refund.

Return Shipping
You have 14 days from the date of your withdrawal notice to send the item back via FedEx. We strongly recommend using FedEx for your return, as your order was originally delivered via FedEx. Using the same carrier simplifies customs document matching and helps avoid delays or additional charges at Turkish customs.

Please share your FedEx tracking number with us once your return has been shipped.

L'EAUPHANT cannot assume responsibility for items lost, stolen, or damaged in transit when returns are sent using a carrier other than FedEx.

Free returns are not available. The customer is responsible for all return shipping costs. Returns sent on a collect-on-delivery or bill-recipient basis are not permitted. Should such a shipment be received, the shipping charges will be deducted from the refund amount.

Customs Declaration
When shipping your return, you must declare the package as "Returned Goods" on the customs declaration form provided by FedEx. Include the original order value and a description of the item. Do not declare the package as a gift, a new purchase, or leave the description blank.

Please include the original invoice inside the package.

If the customs form is filled out incorrectly or incompletely, the shipment may be treated as a new import by Turkish customs, resulting in additional duties and taxes (including 10% VAT on textile goods). The customer is fully responsible for any such additional costs, and these will be deducted from the refund. The refund will be processed on the remaining balance after all applicable deductions.

Category-Specific Conditions
Footwear & Boxed Items

Shoes should be tried on carpeted surfaces only to prevent sole marks. Footwear, clothing, and all boxed items must be returned in their original, undamaged box — the box is considered part of the product. Items returned without their original box or with a damaged box will not be accepted. Boxed items should be shipped inside a protective outer carton to avoid transit damage.

Non-Returnable Items (Hygiene)

Hair accessories, underwear, and swimwear or bikinis with removed or damaged hygiene seals cannot be returned.

Personalised Products

Orders for personalised or custom-made items are final and cannot be returned or exchanged.

Exchanges
Standard practice involves returning the original item and placing a new order.

Refund Process
Once the returned item arrives at our warehouse, it will undergo a quality inspection. If it meets our return conditions, a refund will be issued to the original payment method, excluding the initial delivery charges. Processing times may vary depending on banking procedures — you will receive a confirmation email once the refund has been initiated.

Failed Delivery
L'EAUPHANT cannot be held responsible for delivery failures resulting from incomplete or incorrect address details, the inability to leave the parcel at the recipient's location, refusal of delivery, or any missing information that prevents successful shipment.

In such cases:

• If the order needs to be re-shipped, all related shipping fees will be charged to the customer.
• Any additional costs incurred due to incorrect or incomplete address information are the responsibility of the customer.
• If delivery is refused at the door, the return shipping cost to our warehouse will be deducted from the refund.

11. Disclaimer of Warranty

To the extent permitted by law, products are provided “as is” without implied warranties of merchantability or fitness for a particular purpose.

12. Governing Law & Jurisdiction

These Terms of Sale are governed by the laws of the Republic of Turkey.
