These Terms, together with the Privacy and Cookie Policy and any Special Terms displayed at the time of purchase, constitute the entire agreement between the customer and L'EAUPHANT concerning the use of the website and the purchase of products.

If any provision is deemed invalid or unenforceable, the remaining provisions shall remain in full effect.

All purchases made through leauphant.com are subject to these Terms of Sale and, where applicable, any Special Terms displayed at the time of purchase. By using this website and completing an order, you acknowledge and accept these terms in full.

This platform is intended solely for personal, non-commercial use. The purchase of products for resale or commercial redistribution is strictly prohibited.

By placing an order, the customer confirms that they are at least eighteen (18) years old, or are completing the order under the authorization of a parent or legal guardian.

Each order is governed by the terms in effect at the time of purchase.

Account creation

You may place an order by creating a customer account, logging into an existing account, or checking out as a guest. You are responsible for maintaining the confidentiality of your account credentials. An account allows you to track orders, initiate returns, manage billing and delivery addresses, and manage newsletter preferences.

Placing an order

For each product, the order summary will display price, colour, reference details, and quantity. Once confirmed, the order is transmitted to L'EAUPHANT for processing. Product colours and visuals may vary due to technical display differences and shall not be considered a defect.

Personalised products

Orders for personalised or custom-made items are final and cannot be cancelled, exchanged, or returned.

All products are offered subject to availability. Quantity limits per customer may apply where necessary. If a product becomes unavailable after purchase, the order will be cancelled and fully refunded.

Pre-orders

For pre-order items, the estimated availability date displayed on the product page is indicative and not contractually binding. Payment is charged at the time of order confirmation. The customer may cancel a pre-order at any time prior to dispatch by contacting customercare@leauphant.com; the order will be fully refunded within five (5) business days.

Production delays may occur due to material, atelier, or logistical conditions. L'EAUPHANT will communicate any material change to the availability date by email.

By clicking "Pay" or the equivalent confirmation button, you finalise your order. An order constitutes an offer to purchase, accepted by L'EAUPHANT upon confirmation. L'EAUPHANT reserves the right to refuse or cancel any order at its discretion, including but not limited to cases of suspected fraud, pricing errors, stock unavailability, or restricted shipping destinations. In such cases, any amount charged will be refunded in full.

Cancellation prior to dispatch

Once an order is confirmed, modifications are not possible. However, the customer may request cancellation by emailing customercare@leauphant.com prior to dispatch. If the order has not yet been shipped, it will be cancelled and refunded in full within five (5) business days. Once shipped, the order is governed by the Right of Withdrawal terms.

Prices are displayed in the currency applicable to the customer's selected region. For international orders, VAT, customs duties, and import taxes are not included and remain the responsibility of the customer. Payment is charged at the time of order confirmation.

Accepted payment methods

L'EAUPHANT processes all transactions through Shopify Payments, a PCI-DSS Level 1 compliant payment infrastructure. Accepted methods include Visa, Mastercard, American Express, Apple Pay, Google Pay, and Shop Pay.

Card details are encrypted via TLS and are never stored or accessible by L'EAUPHANT. 3D Secure authentication is applied where supported by the issuing bank.

All transactions are processed in the currency applicable to the customer's region. Currency conversion and any associated fees applied by the issuing bank are the responsibility of the customer.

International shipping

All international shipments are dispatched under DAP (Delivered At Place) terms. Accordingly, the customer is responsible for import duties and taxes, customs clearance procedures, and storage, brokerage, or administrative fees.

L'EAUPHANT cannot be held responsible for customs-related delays or additional charges imposed by local authorities. Customs practices may vary by country; customers are advised to consult their local regulations prior to ordering. Estimated delivery times are indicative and not contractually binding.

All deliveries require a signature upon receipt. Certain categories, including made-to-order or custom items, may require extended preparation and delivery times.

If delivery is delayed beyond ten (10) business days from the estimated date, the customer should contact customercare@leauphant.com. Any visible damage or discrepancy must be noted at the time of delivery.

Products remain under L'EAUPHANT's responsibility until delivery. Risk transfers to the customer upon confirmed receipt.

If a product arrives damaged, defective, or materially different from its description, the customer must notify L'EAUPHANT at customercare@leauphant.com within seven (7) days of receipt, accompanied by clear photographs of the item and original packaging.

Where the defect is confirmed, L'EAUPHANT will arrange one of the following at the customer's preference: replacement of the item subject to availability, repair where feasible, or a full refund including return shipping costs. This provision is granted in addition to any statutory rights the customer may hold under applicable consumer law.

Right of withdrawal

The customer has the right to cancel the order within fourteen (14) days of receiving delivery, without providing a reason. To exercise this right, please notify us by email at customercare@leauphant.com, including the order number and the reason for return. All returns must be pre-approved — returns sent without prior notification will not be accepted, and any costs incurred will remain the customer's responsibility.

Return conditions

To be eligible for a return, the item must be unused, undamaged, and in resalable condition, exactly as delivered; include the original box, packaging, tags, seals, accessories, and invoice; and show no signs of use beyond reasonable inspection.

L'EAUPHANT reserves the right to refuse returns of items that have been worn, altered, damaged, or are not in resalable condition. Any loss in value resulting from handling beyond what is necessary to inspect the item may be deducted from the refund.

Return shipping

The customer has fourteen (14) days from the date of withdrawal notice to send the item back via FedEx. We strongly recommend using FedEx for the return, as the original order was dispatched via FedEx; using the same carrier simplifies customs document matching and helps avoid delays or additional charges at Turkish customs.

Please share the FedEx tracking number with us once the return has been shipped. L'EAUPHANT cannot assume responsibility for items lost, stolen, or damaged in transit when returns are sent using a carrier other than FedEx.

Free returns are not available. The customer is responsible for all return shipping costs. Returns sent on a collect-on-delivery or bill-recipient basis are not permitted. Should such a shipment be received, the shipping charges will be deducted from the refund amount.

Customs declaration

When shipping the return, the customer must declare the package as "Returned Goods" on the customs declaration form provided by FedEx, including the original order value and a description of the item. The package must not be declared as a gift, a new purchase, or left blank.

Please include the original invoice inside the package. If the customs form is filled out incorrectly or incompletely, the shipment may be treated as a new import by Turkish customs, resulting in additional duties and taxes (including 10% VAT on textile goods). The customer is fully responsible for any such additional costs, and these will be deducted from the refund.

Category-specific conditions

Footwear should be tried on carpeted surfaces only to prevent sole marks. Footwear, clothing, and all boxed items must be returned in their original, undamaged box — the box is considered part of the product. Items returned without their original box or with a damaged box will not be accepted. Boxed items should be shipped inside a protective outer carton to avoid transit damage.

Hair accessories, underwear, and swimwear or bikinis with removed or damaged hygiene seals cannot be returned.

Exchanges

Standard practice involves returning the original item and placing a new order.

Refund process

Once the returned item arrives at our warehouse, it will undergo a quality inspection. If it meets our return conditions, a refund will be issued to the original payment method, excluding the initial delivery charges. Processing times may vary depending on banking procedures — the customer will receive a confirmation email once the refund has been initiated.

Failed delivery

L'EAUPHANT cannot be held responsible for delivery failures resulting from incomplete or incorrect address details, the inability to leave the parcel at the recipient's location, refusal of delivery, or any missing information that prevents successful shipment.

In such cases: if the order needs to be re-shipped, all related shipping fees will be charged to the customer; any additional costs incurred due to incorrect or incomplete address information are the responsibility of the customer; if delivery is refused at the door, the return shipping cost to our warehouse will be deducted from the refund.

To the extent permitted by law, products are provided "as is" without implied warranties of merchantability or fitness for a particular purpose. This disclaimer does not affect the customer's rights under Defective Items & Damaged Goods or any non-waivable rights under applicable consumer law.
